Terms and conditions

The rules of the sale: who you are buying from, what arrives, when it arrives, and what happens when something goes wrong.

Who you are buying from

A flower shop in Barcelona since 1977. We make the flowers ourselves and deliver them ourselves. There is no booking agency in between.

Products and prices

What each product is made of is described on its own page. Because we work with fresh flowers, the structure, contents and colour of an arrangement may vary with the season and with what accessories are available. What does not vary is the quality: we guarantee that both the flowers used and the design are of a high standard.

There is one exception, and it works in your favour. Where the product itself names what goes into it — a dozen roses, for instance — you receive exactly that.

All our prices include VAT and delivery. The price shown when you choose the delivery town is the price you pay. Nothing is added at the end.

Around Valentine’s Day and Sant Jordi, flowers cost more across the whole market. Those prices apply on set dates and are already shown on the site while they are in force.

Ordering and payment

Orders are placed on this website, in English, and paid in euros by card.

Payment is handled by Redsys, the Spanish bank card network. Your card details are typed on their secure page, not ours: our shop has no access to them. We receive your order and the confirmation that the payment was made, and nothing else. Redsys uses the current cardholder authentication systems of the card schemes.

An order becomes a contract when the payment is confirmed. You will get an email with the order number; quote it if you need to write to us about the order.

Delivery

Orders are delivered to the address you give us, together with a card carrying the message you wrote. We cannot take responsibility when a delivery fails because the details we were given were wrong or incomplete.

If nobody is there, we take whatever steps are reasonable in the circumstances so the flowers arrive as soon as possible, to the satisfaction of both sender and recipient. We are not responsible for a delay caused by the recipient being out.

Hotels, hospitals, airports, public buildings and any other place with restricted access: we cannot guarantee that the flowers reach the recipient in person. The order is complete, and our responsibility ends, when they have been handed over at reception or at whatever serves as access control.

Same-day delivery is guaranteed when the order and the payment are both in before the cut-off time of the slot you chose. Each slot has its own cut-off; they are listed here, and the order form will not offer you a slot that has already closed. The delivery window itself is a guide: it can be affected by things outside our control — traffic, weather, a mechanical or computer failure.

Weekends and holidays. The calendar in the order form only offers dates and slots we can actually deliver, so if you can select it, we can do it. Weekends are mornings only, and from 21 June to 21 September we do not deliver on Sundays. Public holidays vary.

Busy days. On Mother’s Day, Valentine’s Day, Sant Jordi, Christmas and similar dates, the time you choose is taken as a guide only: delivery may be made at any point during the day, and we deliver as early as we can.

Where we deliver, and the fee for each town. There are separate pages for hospitals and clinics and for funeral homes, because both need extra details from you.

Changes, cancellations and refunds

To cancel or change an order, contact us as soon as you can and always before the delivery has been made: on WhatsApp +34 932 994 016 or by email to info@floristeriaemi.com, quoting the order number.

Because this is a perishable product, we do not accept returns. There are two exceptions, and they are the ones that matter: the product arrived faulty — flowers or a plant in poor condition — or we delivered the wrong item. In either case make the claim within 12 hours of the delivery and we will put it right.

A photograph helps and costs you nothing. It lets us see the problem the same day rather than argue about it.

Perishable goods are also outside the standard 14-day right of withdrawal that applies to most online purchases in the European Union. That is not a rule of ours; it is how the law treats fresh flowers, which cannot be sent back and resold.

Your data

The details we ask for are the minimum needed to carry out the order. They are not used for anything else and are not passed to anyone whose involvement is not necessary to deliver your flowers.

You can exercise your rights of access, rectification, erasure and portability, and of objection to and restriction of processing, by writing to info@floristeriaemi.com, and you can lodge a complaint with the Agencia Española de Protección de Datos. Applicable law

The sale is made in Spain and these terms are governed by Spanish law.

If you are buying as a consumer, you also keep the mandatory consumer protections of the country you live in. Nothing on this page takes away a right the law gives you.

If something goes wrong

Tell us first. We are a small shop and the person who reads your message is the person who made the flowers, which is usually the fastest way to fix anything.

If we cannot sort it out between us, a consumer in Spain can take the matter to the consumer authorities — in Catalonia, the Agència Catalana del Consum.
